Please read carefully. By enrolling in a retreat offered by The Golden Hour Studio, LLC, you are agreeing to the terms of this Release of Liability and Assumption of Risk as a condition of participation.
Nature of Activities
Golden Hour Studio retreats may include, but are not limited to, the following activities: hiking and nature walks, yoga and movement practices, breathwork, ecstatic dance, fire ceremonies, grief circles, somatic practices, and other group or individual wellness experiences. These activities are conducted at third-party venues including hotels, private retreat centers, and natural outdoor environments, some of which are located internationally.
Assumption of Risk
You acknowledge and agree that participation in retreat activities involves inherent physical, emotional, and environmental risks. These risks include, but are not limited to: physical injury during movement-based activities, emotional activation during grief processing practices, illness or injury while traveling internationally, conditions at third-party venues outside our control, and risks associated with outdoor environments. You voluntarily and knowingly assume all such risks, whether known or unknown, in connection with your participation.
Release of Claims
In consideration of being permitted to participate in a Golden Hour Studio retreat, you, on behalf of yourself and your heirs, personal representatives, and assigns, hereby release, waive, and discharge The Golden Hour Studio, LLC, its members, officers, employees, contractors, facilitators, and venue partners (collectively, “Released Parties”) from any and all claims, liabilities, losses, damages, costs, and expenses arising from or in any way connected with your participation, including claims arising from the negligence of the Released Parties, to the fullest extent permitted by California law.
Third-Party Venues
Golden Hour Studio retreats are held at third-party venues and properties. The Golden Hour Studio, LLC does not own, operate, or control these venues and is not responsible for the condition, safety, or suitability of venue facilities, equipment, or grounds. By participating, you acknowledge that venue-related risks are assumed by you as a participant.
International Travel
For retreats held outside the United States, you acknowledge the additional risks associated with international travel, including health and safety standards that may differ from those in the United States, limited access to emergency medical services, and political, environmental, or logistical conditions outside our control. You agree that The Golden Hour Studio, LLC is not liable for any harm, loss, or expense arising from international travel risks.
Health Representation
By enrolling, you represent that you are in adequate physical and emotional health to participate in retreat activities, or that you have disclosed any relevant health conditions through our intake process. You agree that it is your responsibility to consult a qualified healthcare provider before participating if you have any concerns about your fitness to do so.
Indemnification
You agree to indemnify and hold harmless the Released Parties from any claims, damages, or costs (including reasonable attorneys’ fees) arising from your breach of this agreement or your conduct during a retreat.
Severability
If any provision of this Release is found to be unenforceable, the remaining provisions shall remain in full force and effect.
